⦁ Do I need to be physically present in Poland to complete a real estate transaction?
No, your physical presence is not required. In Poland, all real estate transfers must be executed in the form of a Notarial Deed before a Notary Public. Our firm can prepare a specific Power of Attorney (PoA) for you. Once executed, we can represent you during the entire process, including signing the final deed and handling the closing on your behalf.
⦁ Can a foreigner freely purchase property in Poland?
It depends on the type of property and your citizenship. Generally, citizens of the European Economic Area (EEA) can purchase apartments and land freely. For non-EEA citizens, a permit from the Ministry of Interior and Administration may be required. We provide full legal screening to determine if a permit is necessary for your specific case.
⦁ How do you verify the legal status of a property?
We conduct a thorough due diligence process. This includes verifying the Land and Mortgage Register for any existing mortgages, claims, or encumbrances, checking the zoning plans, and ensuring there are no outstanding administrative issues or tax arrears associated with the property.
⦁ My relative passed away in Poland, but I live abroad. Can you handle the inheritance process for me?
Yes, we specialize in representing international heirs. You do not need to travel to Poland to claim your inheritance We can act on your behalf based on a Power of Attorney (PoA), representing you before Polish courts or in front of a Notary Public to finalize the succession proceedings.
⦁ How do I know if Polish law applies to my inheritance case?
Under the EU Succession Regulation (Brussels IV), the law applicable to the entire succession is generally the law of the country in which the deceased had their habitual residence at the time of death. However, there are exceptions, especially if the deceased made a „Choice of Law” in their will. We provide a detailed legal analysis to determine which jurisdiction applies to your specific situation.
⦁ My relative was a Polish citizen but lived and died in the USA. Do I need to conduct probate in Poland?
Yes, if the deceased owned assets in Poland (such as real estate or bank accounts), a separate inheritance proceeding must be conducted here. While US documents are important evidence, Polish courts and land registries require a formal Polish Confirmation of Inheritance. Our firm specializes in bridging these two legal systems, ensuring that your rights to Polish assets are fully recognized without you having to travel from the US.
⦁ What happens if the deceased left a will in another country?
A foreign will is generally recognized in Poland, but it often requires a formal translation by a sworn translator and, in some cases, additional legal validation. We assist in the process of „opening and announcing” a foreign will before a Polish court to ensure it is legally effective regarding assets located in Poland.
⦁ Does the firm help with locating „hidden” assets or real estate?
Yes. If you are unsure of the full extent of the estate, we can conduct a search of the Land and Mortgage Registers and other public records in Poland to identify real estate, bank accounts, or corporate shares owned by the deceased.
⦁ Can you help with debt collection if the debtor is based in Poland?
Yes. We represent foreign creditors in both pre-litigation (amicable) settlements and court proceedings. We assist with obtaining a payment order, navigating bankruptcy proceedings, and working with bailiffs (komornik) to ensure effective enforcement of the debt within the Polish jurisdiction.
